New NPDES Construction Permit in Effect Aug. 1, 2018

The National Pollution Discharge Elimination System (NPDES) permit for construction activity will expire on August 1, 2018. The new permit has been finalized and is available on the construction stormwater web page. The permit will not become effective until August 1, 2018. If you are applying for the permit before August 1, 2018 you will be covered under the 2013 permit. Permittees covered under the 2013 permit will need to complete the project within 18 months of the issuance date of the new permit or revise the stormwater pollution prevention plan for the project to reflect the new requirements. A red lined version of the permit showing all changes from the draft permit to the final permit was also created. The redlined draft permit, public comments received, and response to comments documents are also available on the construction stormwater web page:

A fact sheet was prepared according to the 40 CFR § 124.8 and 124.56 and Minn. R. 7001.0100, subp. 3 in regards to a draft NPDES/SDS permit. The fact sheet and other documents related to the development of the final permit will be available on the construction stormwater website soon.
