On Nov. 4, 2021, the Occupational Safety and Health Administration (OSHA) announced its Emergency Temporary Standard (ETS) to address mandatory COVID-19 vaccination and testing for the workplace. The ETS requires affected employers to comply with most provisions by Dec. 6, 2021, and with its testing requirements by Jan. 4, 2022. Affected employers include private employers with 100 or more employees (firm- or company-wide count). State plans will have 30 days to adopt the federal ETS or implement their own vaccination standard.

Federal Court Blocks OSHA COVID-19 Vaccination and Testing ETS

On Saturday, Nov. 6, 2021, the Fifth Circuit Court of Appeals ordered a temporary stay on the ETS. The order effectively prevents enforcement of this ETS until a final decision regarding the legality of this standard is published. On Friday, Nov. 12, the Fifth Circuit affirmed its hold on the ETS.

According to an article by The National Law Review: 

This is not the end of the judicial review road for the vaccine rule. Challenges to the rule were filed in multiple federal circuit courts across the country. When there are multiple filings like these, a multi-circuit “lottery” system is utilized for purposes of consolidation and clarity. All of the appeals are consolidated before the circuit court selected in the blind lottery, which will then hear the challenge to the rule.

If the Fifth Circuit is not selected in the lottery, then another appeals court will have an opportunity to issue the controlling decision here (which could, among other things, lift the Fifth Circuit’s stay). After that, regardless of the outcome, the Supreme Court will likely have the final word.

Impact on Employers

While the temporary stay effectively prevents enforcement of the ETS until a final decision on the legality of the standard is published, the law has not been permanently delayed or vacated officially. As a result, affected employers should continue in their efforts to understand and prepare for compliance with the various provisions of the ETS.

Speaker Pelosi’s revised deadline of Oct. 31 for the House to pass the $1.2 trillion bipartisan infrastructure bill came and went without action. The showdown between President Biden / Speaker Pelosi and the Congressional Progressive Caucus continues to hold up passage of the Bipartisan Infrastructure Bill (BIF), passed in a bipartisan basis in the Senate in August.

After a much-publicized trip to the Hill by the President, a pared down $1.75B Build Back Better (BBB) Act framework was released and was endorsed by the House Democratic progressives subject to seeing a full draft. As the full draft was not ready for release, the President left for Glasgow for the COP21 climate change summit empty handed.

2022-2024 Proposed DBE Goals Public Hearings

The Minnesota Department of Transportation invites public comment on the proposed statewide

goals for Disadvantaged Business Enterprise participation in highway and transit contracts for federal fiscal years 2022‐2024.

The DBE program is an affirmative action program intended to level the playing field by providing contracting opportunities for small businesses that are owned and controlled by socially and economically disadvantaged individuals.

MnDOT is required by the Federal Highway Administration and Federal Transit Administration to set statewide goals for disadvantaged business participation in federally funded projects over the next three years. The proposed FHWA and FTA goals will be posted on August 2, 2021, visit http://www.dot.state.mn.us/civilrights/dbe-goal.html

Two virtual public hearings are scheduled on the following dates to discuss the goals and methodology and receive public comment:

MUCA Legislative Update July 2, 2021

Special Session Ends – No Government Shutdown

Legislative leaders worked at a slow but steady pace during a special session of the Minnesota Legislature called by Gov. Walz to begin on June 14. The special session was necessary to resolve differences between House and Senate budget bills.

In order to avert a state government shutdown, funding bills needed to be passed by June 30, and in typical legislative form, the final agreed to bill was not approved by the legislature until late in the evening of the deadline.

Gov. Walz has signed all the budget bills and there will not be a state government shutdown.

Update to COVID-19 Restrictions

This week, an agreement was reached between the House and Senate on the State Government, Elections & Veterans omnibus bill, but not without a little controversy. When it came time for a vote in the Senate, an amendment was added ending Gov. Walz’s peacetime emergency on July 1. Initially, the governor was concerned with the timing because he believed he needed some more time to assure certain federal funding would continue. However, he eventually agreed to end his peacetime emergency powers, in place since March 2020, because he came to realize the federal aid would likely continue without it.

Passage and signing of the bill has effectively ended the peacetime emergency in Minnesota.

Unfair MnOSHA Reporting/Employer Mandates

During the regular 2021 Legislative Session, MUCA Executive Director Stephanie Menning testified before the Omnibus Workforce and Business Development Finance and Policy Bill (SF1098/HF1342) conference committee in opposition to a House provision allowing MnOSHA to publish citations as soon as an employer receives the citation.

MUCA actively opposed the measure throughout the legislative session maintaining that publishing citations before due process has been served will unfairly tarnish business reputations. MUCA rejected a “compromise” offered by MnOSHA presented to Menning that would allow the citation to be publish twenty days after being received by an employer. Twenty days is insufficient for employers to receive due process, especially if litigation is pursued. 

In the end, the onerous provision was not included in final version of the bill which passed during the special session.

Additional Employer Mandates - Jobs

In addition to testifying in committee, Stephanie Menning also submitted a letter to the conference committee opposing the unfair MnOSHA provision and supporting funding for the  Helmets to Hardhats program. Helmets to Hardhats received $225,000 in funding during the special session.

Due to strong opposition from groups like MUCA, the Minnesota Chamber of Commerce, the Senate, and approximately 100 other groups, the following employer mandate bills/provisions were not included in any final budget bills and will not become law.

  • HF1200/SF1205 - Paid Family and Medical Leave Benefit Insurance Program
  • HF7/SF29 - Earned sick and safe time including civil penalties
  • HF41/SF331 - Emergency paid sick leave for essential workers unable to work or telecommute due to a COVID-19 related reasons

Other provisions in the jobs funding bill (SF9-Pratt/Noor) include:

  • $150 million appropriation to fund the Main Street Economic Revitalization Program and the Main Street COVID-19 Relief Grant Program
  • $35 million for grants to Minnesota Initiative Foundations to serve businesses in Greater Minnesota
  • $35 million for grants to partner organizations to serve businesses inside the metro area
  • $20 million for the Minnesota Investment Fund
  • $16 million for the Job Creation Fund
  • $8.4 million for the Minnesota Job Skills Partnership program
  • $8.1 million for the Minnesota Youth Program
  • $7.2 million for the Pathways to Prosperity Competitive Grant program
  • $6.2 million in fiscal year 2022 for project development of the Rondo neighborhood land bridge over Interstate Highway 94 in St. Paul
  • $5 million for grants to local communities to increase the number of child care providers;
  • $4.9 million for wage theft prevention
  • $2 million for competitive grants to organizations providing services to relieve economic disparities in the Southeast Asian community
  • $2 million for competitive grants to organizations providing services to relieve economic disparities in the African immigrant community
  • $1 million for rural career counseling coordinators

Other highlights include:

  • Requiring high-rise public housing buildings to be retrofitted with automatic sprinkler systems to meet current building codes
  • Permitting high school students to qualify for unemployment insurance
  • Requiring an employer with 15 or more employees to provide new mothers with reasonable accommodations for health conditions related to pregnancy or childbirth
  • Expanding options for individuals to receive unemployment benefits while undergoing workforce training
  • Eliminating the Social Security old age and Social Security disability offset (deduction) from unemployment benefits

Transportation

Gov. Walz has signed a special session transportation funding bill (HF10) which provides billions of dollars for the state’s roads, bridges and public transportation system. The heavily negotiated bill passed during the special session with strong bipartisan support in the House and Senate.

The $7.27 billion bill includes $220.4 million in new transportation funding. The total appropriations by agency include $6.49 billion for the Department of Transportation, $516.3 million for the Department of Public Safety and $235.7 million for the Metropolitan Council.

There is also $213 million in trunk highway bonding authorized in fiscal year 2022 and an additional $100 million in each year of the 2024-25 biennium for the Corridors of Commerce program.

One-time General Fund appropriations for MnDOT include:

  • $18 million for the Small Cities Assistance Program
  • $14 million for the local bridge improvement
  • $12 million for town roads (above the formula-based distribution)
  • $10 million for second daily Amtrak service between Minneapolis/St. Paul and Chicago
  • $5.5 million for the Local Road Improvement Program
  • $300,000 for a grant to the Interstate Highway 494 Corridor Commission

One-time General Fund appropriations for the Metropolitan Council include:

  • $57.5 million for arterial bus rapid transit projects
  • $250,000 for a zero-emission transit vehicle transition plan
  • $250,000 for an analysis of transit service in a Trunk Highway 55 corridor

There is also $213 million in trunk highway bonding authorized in fiscal year 2022 and an additional $100 million in each year of the 2024-25 biennium for the Corridors of Commerce program.

The fiscal year 2022 appropriation allocates $100 million for state road construction and $113 million for Regional and Community Investment Priorities that are listed in a June 19 letter from MnDOT to legislative leaders and the chairs of the House and Senate transportation committees.

MnDOT outlined how funding will be used for several specific projects:

  • $31 Million for Ramsey Gateway/U.S. Highway 10
  • $30 million for U.S. Highway 10 in Wadena
  • $27 million for Interstate Highway 94 Westbound in Albertville
  • $25 million for U.S. Highway 212 in Carver County

Several other projects would be paid for through the General Fund, including:

  • $8 million for expansion of U.S. Highway 8 from two to four lanes in Chisago County
  • $7 million for 99th Avenue and Trunk Highway 65 in Blaine
  • $3.5 million for a bridge over Interstate Highway 694 in Washington County
  • $3.03 million for Sherburne street and utility reconstruction
  • $2.5 million for U.S. Highway 169, Trunk Highway 282 & County State Aid Highway 9 in Scott County
  • $2.5 million for studies of Trunk Highways 3, 77 and 55
  • $1.5 million for a roundabout on Trunk Highway 41 in Chanhassen
  • $1.4 million for a study of Interstate Highway 35 in Dakota County
  • $1 million for a study of U.S. Highway 10 in St. Cloud
  • $500,000 for a study of I-35 and County State Aid Highway 9 in Rice County

Not included in the bill are any tax increases.

Taxes

During the special session, the House and Senate passed and Gov. Walz has signed, an omnibus tax bill. HF9 (Marquart/Nelson), was the final funding bill passed. The bill raises revenue $49.1 billion in revenue and provide $4.2 billion in refunds, aids and credits, including $761 million in new tax cuts and credits.

The largest provision of the $761 million state tax law brings Minnesota into conformity with the federal government on tax exempt status for forgiven Paycheck Protection Program loans and unemployment benefits up to $10,200. The Revenue Department is expected to provide guidance to taxpayers on amending their 2020 tax returns.

MUCA supported and lobbied in favor of providing state tax relief for PPP loans.

Other highlights include:

  • Adopting numerous federal tax changes enacted by Congress since December 31, 2018
  • Extension of the small business investment credit (angel credit) and historic structure rehabilitation credit
  • Increasing the commercial/industrial statewide property tax exclusion from $100,000 to $150,000
  • Eliminating the state addition for section 179 carryovers for property placed into service prior to tax year 2020
  • Establishment of new state tax credits for film production and charitable contributions to a housing investment fund at Minnesota Housing
  • Modifying the student loan credit calculation to reduce the marriage penalty
  • Establishing a state subtraction for payments from charitable contributions to volunteer drivers

The agreed to tax bill also contains language which modifies Minnesota’s reporting and payment requirements generated by federal audits and assessments in response to federal changes enacted in 2015, which provided for conducting audits at the partnership level, rather than at the partner level. This article requires state reporting of federal adjustments from a partnership-level audit and allows assessments to be paid at the entity level.

Another important section of the bill establishes a fully refundable pass-through entity tax that allows electing pass-through businesses to pay state income tax at the entity level and deduct this tax for federal income tax purposes. Under federal law, taxes on pass-through income are subject to the SALT cap of $10,000.

The bill contains dozens more provisions on income, sales, and property taxes.

Capital Investment/Bonding

“Odd numbered” years of the legislative cycle are not traditionally years that produce capital investment bills and this was the case in 2021. With so many differences in policy and funding initiatives between the House, Senate, and Governor, a bonding bill was not a high priority. However, 2022 is a traditional bonding year. Expect to see action then.

Legalization of Recreational Marijuana         

During the regular session, the House approved legislation proposing to legalize cannabis for adults by a vote of 72-61. HF600 (Winkler) traveled to nearly every House committee before being approved on the House floor. The companion bill did not receive a hearing in the Senate and the bill did not become law.

MUCA opposes legalization or recreational marijuana.

Looking Ahead

While additional employer mandates proposed in the House were not included in the final Jobs bill, MUCA member can expect to see them again in the 2022 Legislative Session.

This webinar focuses on WHY these topics are imperative for construction leaders at all levels. Learn what you and your organization can do to promote mental wellbeing and reduce the risk of suicide among your workforce and the construction industry.

An OSHA inspector arrives at yor job site just before lunch on a Monday.  This was not the way your crew was planning to start its work week. 
 
In this presentation, your Project Managers, Safety Director, Foremen, Superintendents, and Owners will learn: 

  • What are the first five things that I do if OSHA shows up on-site? 
  • Can I get a lawyer involved and, if so, what are the advantages? 
  • How do I handle witness interviews of management employees and non-management employees? 
  • Do I agree to be audio recorded when OSHA interviews me? 
  • What steps can I take during the Opening Conference and walk-around with the OSHA inspector to put my company in the best possible light? 
  • About 70% of OSHA inspections lead to Citations. 

By attending this seminar, you can learn how to be in the 30% group of employers who do not receive OSHA Citations even if OSHA conducts a site visit. 
 
Also learn during this seminar how your company’s safety record impacts your insurance premiums, your company’s ability to bid work, and your company’s ability to be pre-qualified.

Aaron Dean, Moss & Barnett

Aaron Dean of Moss & Barnett has handled more than 300 OSHA cases in 22 States, including more than 30 fatality cases.  Mr. Dean has had two trials against MnOSHA in 2021 and routinely handles fatality, serious injury, and non-injury cases.  Mr. Dean also recently secured the complete dismissal of a fatality Citation issued by MnOSHA.  Mr. Dean is a construction lawyer and is licensed to practice in Minnesota, North Dakota, and Wisconsin.  He regularly handles about 10 trials per year.

CSDZ is partnering with the following Minnesota Construction Associations for this Webinar:  Aggregate and Ready Mix Association (ARM), American Council of Engineering Companies (ACEC), American Institute of Architects (AIA), Associated General Contractors (AGC), Association of Women Contractors (AWC), Concrete Pavement Association (CPA), Construction Financial Management Association (CFMA), Minnesota Asphalt Pavement Association (MAPA), Minnesota Builders Exchange (MBEX), Minnesota Utility Contractors Association (MUCA), Sheet Metal, and the Air Conditioning & Roofing Contractors Association (SMARCA).

In addition, The Minnesota Building and Construction Trades Council is also participating with CSDZ for this webinar. The MN Trades Council consists of 15 trades and 48 affiliated local unions representing 70,000 workers in Minnesota.

Second Committee Deadline

The second legislative committee deadline was midnight on Friday, March 19. Committees must have acted favorably on policy bills, or companions of bills, that met the first deadline in the other house. Bill’s that do not make this deadline could resurface as amendments to bigger bills or be part of final negotiations but are to be considered “dead.” Winnowing the number of bills in play is a method the legislature uses to narrow its focus to passing a budget and finishing its work in May.
